Terms of Service

These terms are an agreement between you and Weightech USA LLC, a Florida limited liability company (“WeightechUSA”, “we”, “us”) for the use of WSysFarm: the mobile app for Android and iOS, the web portal at app.wsysfarm.com/portal, the sync server behind them and the website wsysfarm.com (together, the “Service”). Please read them — they include important limits on our responsibility for decisions you make using the Service.

1. Accepting these terms

You accept these terms by ticking the box when you create an account or accept a team invitation, or by using the Service. We record the version you accepted (this version is 2026-10-06). If you use the Service for a farm, ranch or company, you confirm that you are allowed to accept these terms on its behalf, and “you” includes that business.

You must be at least 18 years old, or the age of majority where you live, to create an account. Our Privacy Policy explains how we handle personal information and is part of these terms.

2. Accounts and team members

  • Give accurate information and keep your password private. You are responsible for everything done with your account. Tell us right away at sales@weightechusa.com if you think someone else has used it.
  • The person who creates a farm account is its owner. Owners can invite members by email, change their roles and remove them. The owner is responsible for the farm account, its plan and payments, and for the people they invite.
  • Everyone in a farm account can see and change that farm’s records. Only invite people you trust with them.
  • If an owner deletes the farm account, the whole farm account — including its records and its team members’ access — is deleted.

3. Plans, billing and cancellation

3.1 Plans

Plans are priced by the number of active animals. Sold, deceased and archived animals do not count toward your limit. Current plans:

  • Free — up to 25 active animals, no card required.
  • Pro — up to 250 active animals, US$12 per month.
  • Farm — up to 1,000 active animals, US$29 per month.
  • Enterprise — unlimited animals, priced by agreement.

Current prices are shown on wsysfarm.com and in the portal. All prices and billing are in US dollars (USD). Prices do not include taxes; you are responsible for any taxes or fees your bank or country charges (for example, IOF on international card payments in Brazil). If you reach your plan’s limit, you will not be able to add more active animals until you upgrade or mark animals as sold, deceased or archived. Your existing records are not affected.

3.2 Billing and automatic renewal

Paid plans are billed in advance through PayPal and renew automatically every month until you cancel. By subscribing, you authorize PayPal to charge your chosen payment method each month. If you change between paid plans, PayPal applies any price difference proportionally. If we change a plan’s price, we will tell you at least 30 days before the change applies to you, and you can cancel before then.

3.3 Cancelling

You can cancel at any time in the web portal (plan and billing settings) or in your PayPal account. Cancellation stops future renewals; unless you request a refund (see 3.4), your paid plan stays active until the end of the period you have already paid for, and then the account moves to the Free plan. The same happens if a payment fails and PayPal suspends the subscription. Your records are not deleted when you cancel.

3.4 Refunds

  • 7-day cancellation: you can cancel a new subscription within 7 days of purchase for a full refund.
  • Unused time: if you cancel a paid plan, you may request a refund of the unused portion of the current billing period by emailing sales@weightechusa.com.
  • Refunds are issued to the original PayPal payment method. If you request a refund, the paid plan ends when the refund is issued and the account moves to the Free plan.

4. Your data

  • You own your farm data. Everything you enter or import remains yours.
  • You give WeightechUSA a limited permission to store, copy, process, transmit and display your data only as needed to provide, secure, back up and support the Service for you. This permission ends when your data is deleted, except for copies in backups until they expire.
  • We may use aggregated, de-identified statistics about how the Service is used (for example, page-view counts) to run and improve it. These cannot identify you or your farm.
  • You can download your data from the portal (Download my data) at any time. We recommend keeping your own copy — our backups exist to recover from failures, not to restore individual records on request.
  • The app works offline. When the same record is changed in two places before syncing, the most recent change wins.
  • You are responsible for having the right to enter any information about other people, and for complying with laws that apply to your records (for example, animal identification, traceability and drug-withdrawal record-keeping rules).

5. Acceptable use

Do not:

  • break the law or infringe anyone’s rights using the Service;
  • try to access other people’s accounts or data, or get around plan limits, security or rate limits;
  • probe, scan or test the Service’s vulnerabilities without our written permission (please report security issues to us instead);
  • overload, disrupt or interfere with the Service, or use bots or scrapers on it beyond the features we provide;
  • upload malware or content that is unlawful, harmful or that you do not have the right to share;
  • resell or provide the Service to others as your own service without an Enterprise agreement; or
  • copy, modify or reverse-engineer the Service, except where the law allows it despite this restriction.

6. Weights, calculations and your decisions

Please read this section carefully.

Weights, averages, daily gain, cost of gain, ROI, due dates, gestation estimates, withdrawal dates, reminders and every other figure in WSysFarm are provided for information only. They depend on the accuracy of your scale, its calibration and installation, the Bluetooth connection, the data you enter, and the assumptions built into the calculations.

  • Check that your scale is calibrated and working correctly, and verify important readings before relying on them.
  • Always follow the product label, your veterinarian’s instructions and the law for medication doses and withdrawal periods. WSysFarm is not a veterinary or medical tool.
  • Use your own judgment, and professional advice where appropriate, for sales, pricing, dosing, treatment, culling and breeding decisions.

To the extent permitted by law, WeightechUSA is not responsible for any loss, including financial loss, animal harm, rejected or penalized shipments, or regulatory consequences, that results from decisions about sale, dosing or medication, withdrawal, treatment or breeding made on the basis of data or calculations shown in WSysFarm.

7. Scales, hardware and third parties

  • WeightechUSA scales, indicators and accessories are sold separately. Their warranty is the one that comes with the hardware and is not part of these terms.
  • WSysFarm is designed for WeightechUSA scales and some compatible RFID readers. We do not guarantee that it works with every device, phone or operating-system version.
  • Some parts of the Service rely on third parties — such as PayPal for payments and Apple or Google for app distribution — and their own terms apply to your use of them. We are not responsible for third-party services.

8. Availability and changes

We work to keep the Service available, but we do not promise that it will be uninterrupted, error-free or available at any particular time, and we offer no service-level agreement unless you have a separate written Enterprise agreement. We may need to pause the Service for maintenance, updates or security reasons. We may add, change or remove features; if we remove a major feature you pay for, we will tell you in advance where reasonably possible. Features marked as beta or preview may be less reliable.

9. Our software

WeightechUSA and its licensors own the Service, including the app, portal, server software, design and the WSysFarm and WeightechUSA names and logos. While you follow these terms, we give you a personal, non-exclusive, non-transferable, revocable license to use the Service for managing your farm. If you send us feedback or ideas, we may use them without any obligation to you.

10. Warranty disclaimer

To the extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, title and non-infringement.

11. Limitation of liability

To the maximum extent permitted by applicable law: (a) WeightechUSA will not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, livestock value, data or business opportunities, even if we were told they were possible; and (b) WeightechUSA’s total liability for all claims relating to the Service is limited to the greater of the fees you paid us for the Service in the 12 months before the claim arose, or US$100.

These limitations and exclusions do not apply to liability for gross negligence, willful or intentional misconduct or fraud, or to any liability that cannot be limited by law.

Some places do not allow these exclusions or limits, so they apply to you only as far as your local law allows. They do not affect the mandatory consumer protections of the country where you live — for example, under the Brazilian Consumer Defense Code (Código de Defesa do Consumidor) — as described in section 15. They also do not reduce the importance of section 6: weights and calculations are informational, and decisions you make with them remain your responsibility.

12. Indemnity

If you use the Service for a business, you agree to defend and compensate WeightechUSA for claims, losses and reasonable costs (including legal fees) brought by third parties that arise from your data, your misuse of the Service or your breach of these terms, to the extent permitted by law.

13. Termination and data deletion

  • You can stop using the Service and delete your account at any time — see How to delete your account and data.
  • We may suspend or close an account that seriously or repeatedly breaks these terms, puts the Service or other users at risk, or where the law requires it. Where reasonable, we will warn you first and give you a chance to download your data.
  • When an account is deleted, it is disabled immediately and its data is permanently purged after 30 days. Security audit records are kept in anonymized form. Copies in backups expire on their normal schedule, as described in the Privacy Policy.
  • Sections 4 (as to backups), 6, 9, 10, 11, 12, 15 and 16 continue to apply after the account ends.

14. Changes to these terms

We may update these terms. If a change is material, we will tell you by email or in the portal at least 30 days before it takes effect, and we may ask you to accept the new version. If you do not agree, you can cancel and delete your account before the change takes effect. Continuing to use the Service after that means you accept the new terms.

15. Governing law and disputes

These terms are governed by the laws of the State of Florida and applicable US federal law, without regard to conflict-of-law rules. Disputes will be resolved in the state or federal courts located in Broward County, Florida. There is no arbitration requirement and no class-action waiver, and either party may bring an eligible claim in small claims court instead.

Before starting a formal dispute, please contact us so we can try to resolve it informally. Nothing in these terms removes the mandatory consumer protections of the country where you live — for example, consumers in Brazil keep their rights under the Consumer Defense Code, including the right to bring a claim in the courts where they live.

16. General

These terms, together with the Privacy Policy and any Enterprise agreement you sign with us, are the entire agreement about the Service. If any part is found unenforceable, the rest still applies. If we do not enforce a term right away, we have not given up the right to enforce it. You may not transfer these terms without our consent; we may transfer them as part of a merger, acquisition or sale of the Service. These terms are also available in Portuguese and Spanish. If a translated version differs from the English version, the English version prevails, except where the law of your country requires the version in your language to prevail.
